1. About these terms
These Terms of Use govern your use of www.premierpropertybali.com and its pages (the “Site”), operated by PT Premier Property Group, a foreign investment company (PT PMA), trading as Premier Property Bali (“Premier”, “we”, “us”). By using the Site you accept these Terms. If you do not accept them, please do not use the Site.
These Terms cover the Site only. Any service we provide to you (sale, purchase, letting or management of a property) is governed by a separate written agreement, which prevails over these Terms.
2. Our role
Premier is a real estate agency and property manager. We act as agent or manager on behalf of property owners. We are not the seller, the landlord or the operator of any accommodation listed on the Site, unless a written agreement expressly says otherwise.
3. Listings are information, not offers
Property listings on the Site are general information and an invitation to enquire. They are not an offer to sell, lease or rent, and they do not form a contract. Much of the information is supplied by owners, developers or other agents. We take reasonable care, but we do not independently verify every detail and do not warrant that any listing is complete, accurate or current.
Before you commit to any property, verify everything that matters to you, including the land certificate, the land title type, the zoning, building approvals (PBG and SLF), the remaining lease term, and any licence needed for your intended use, through your own notary (notaris), PPAT and legal advisers.
4. Prices, availability and currency
Prices and availability change without notice, and a property may be sold, let or withdrawn at any time. A price shown is the asking price or rent at the time it was published, and does not include taxes, notary and PPAT fees, or other transaction costs unless stated.
Prices shown in US dollars or other currencies are indicative only, converted at an approximate rate. Any transaction is priced and settled as set out in its written agreement and in accordance with Indonesian currency law.
5. No investment, legal or tax advice, and no guaranteed returns
The Site, including any yield figure, projected income, return on investment or calculator, is general information only. It is not investment, financial, legal or tax advice, and it is not tailored to your circumstances.
Premier does not guarantee any rental income, occupancy, yield, capital growth or return. Any projection is an illustration based on assumptions that may not happen. Actual results depend on the property, the market, licensing, management and many other factors, and you may receive less than projected or lose money. Take independent professional advice before making any decision.
6. Foreign ownership and use of property in Indonesia
Ownership and use of property in Indonesia by foreign nationals and foreign owned companies is restricted by Indonesian law. In summary, and without being legal advice: foreign individuals cannot hold freehold title (Hak Milik); foreigners may hold rights such as Hak Pakai or a lease (Hak Sewa), and foreign investment companies (PT PMA) may hold rights such as Hak Guna Bangunan, each subject to conditions.
Arrangements in which an Indonesian citizen holds property or a licence on behalf of a foreigner (nominee arrangements) are prohibited. Under Article 26(2) of the Basic Agrarian Law (Law No. 5 of 1960) a transfer that gives a foreigner the benefit of Hak Milik is void, and such arrangements may expose the people involved to criminal liability. Premier will not arrange, facilitate or advise on any nominee structure.
Renting a property to guests on a short term basis requires business licences that an individual foreign owner cannot hold in their personal name. Do not assume that a property listed for sale can be operated as a rental by you personally. Take legal advice before buying for that purpose.
7. Using the Site
You agree not to: use the Site for any unlawful purpose; send us false information or information about another person without their permission; copy or scrape listings, photographs or content in bulk; attempt to gain unauthorised access to the Site or its server; or interfere with its operation.
8. Intellectual property
The Site and its content (text, photographs, videos, floor plans, designs, logos and the Premier Property Bali name) belong to Premier or its licensors, including property owners and developers, and are protected by Indonesian and international intellectual property law. You may view and print pages for your own personal, non commercial use. Any other use requires our written permission. Photographs carry the Premier watermark, which must not be removed.
9. Third party links and services
The Site links to and uses third party services (including WhatsApp, Google and social media). We are not responsible for their content, availability or terms, which apply when you use them.
10. Liability
To the extent permitted by Indonesian law, the Site is provided “as is” and “as available”. We do not guarantee that it will be uninterrupted, error free or free of viruses.
To the extent permitted by law, Premier is not liable for any loss arising from your reliance on information on the Site, including any listing, price, projection or calculator, or from your use of or inability to use the Site.
Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, including under Law No. 8 of 1999 on Consumer Protection, or any mandatory consumer rights you have under the law of the country where you live.
11. Privacy
Our Privacy Policy explains how we handle personal data you give us through the Site.
12. Changes
We may change these Terms or the Site at any time. The date at the top shows when the Terms last changed. Continuing to use the Site after a change means you accept the new Terms.
13. Governing law and disputes
These Terms are governed by the laws of the Republic of Indonesia. Any dispute arising from them that cannot be resolved by discussion will be submitted to the District Court of Denpasar (Pengadilan Negeri Denpasar), without affecting any mandatory right a consumer has to bring proceedings in the country where they live.
